1. About these terms

These Terms of Use govern access to and use of theartagents.com (the “Website”). By using the Website, you agree to comply with these terms. If you purchase anything through the Website, the separate Shop Terms and Conditions also apply.

These Terms do not themselves create an artist representation relationship. Artists who are accepted for representation enter into a separate Artist Agency & Representation Agreement.

2. About The Art Agents

The Website is operated by Autaway Limited trading as The Art Agents. The Art Agents is a contemporary art agency and marketplace which represents selected artists, promotes their work and facilitates sales.

Unless a product page expressly states otherwise, The Art Agents acts as the disclosed sales agent for the artist identified on the relevant artwork listing. The separate Shop Terms explain the sales relationship in more detail.

3. Access to the Website

We may update, suspend, withdraw or change all or any part of the Website from time to time. We do not guarantee that the Website, or any content on it, will always be available or uninterrupted.

You are responsible for ensuring that anyone accessing the Website through your internet connection is aware of these Terms and complies with them.

4. Accounts and login details

If you create an account, you must provide accurate information and keep your login credentials confidential. You must tell us promptly if you know or suspect that somebody else has obtained unauthorised access to your account.

We may suspend or close an account where reasonably necessary to protect the Website, investigate misuse, comply with law or enforce these Terms.

5. Intellectual property

The Website and its original layout, copy, branding, graphics, databases, software and other material owned by The Art Agents or Autaway Limited are protected by intellectual property law.

Artwork, artist photographs, artist biographies and other artist material may belong to the relevant artist or another rights holder and are displayed under licence. Purchasing physical artwork does not transfer copyright or other intellectual property rights unless expressly agreed in writing.

You may view and print pages for personal, non-commercial use. You must not reproduce, scrape, republish, sell, licence, systematically download, create derivative commercial databases from, or commercially exploit Website content without permission from the relevant rights holder.

6. Permitted use

You must use the Website lawfully. You must not attempt to gain unauthorised access, introduce malicious software, overload or disrupt the Website, impersonate another person, misuse account functionality, interfere with checkout, scrape the Website at scale without permission, or use the Website for fraud or unlawful activity.

7. Artwork images and information

We aim to present artwork accurately. Screen settings, photography and lighting can affect how colours and textures appear. Dimensions, medium, framing status, edition information and other important details are stated on individual listings where applicable.

Information about artists and artwork is provided for general and sales purposes. Historical, biographical or contextual commentary is not a professional valuation, investment recommendation or guarantee of future value.

8. Reviews and user submissions

The Website may allow customers to submit product reviews or other content. A review must reflect the reviewer’s genuine experience and must not be fake, misleading, defamatory, unlawful, abusive, infringing or submitted in exchange for an undisclosed incentive.

Any incentive provided in connection with a review must be clearly disclosed. We do not permit anyone connected with The Art Agents, an artist or a product to pose as an independent customer.

We may use reasonable and proportionate checks to identify fake, misleading or unlawful reviews and may refuse or remove content where there is a legitimate reason to do so. We will not suppress genuine negative reviews merely because they are negative.

By submitting content for publication, you grant us a non-exclusive, royalty-free licence to display, reproduce and moderate that content for operation and promotion of the Website, while you retain ownership of your own content.

9. Artist applications and enquiries

An enquiry or application for representation does not guarantee acceptance and does not create an agency or representation relationship. Representation begins only when the relevant parties enter into the Artist Agency & Representation Agreement and Commercial Schedule.

Artists must not assume that submitting work gives The Art Agents any obligation to promote, list or sell that work.

10. Trade accounts

Trade accounts are available only to approved galleries, art retailers, interior designers and other eligible businesses. Applications may be checked manually and approval is at our discretion.

We may request reasonable information to verify trade status and may suspend or withdraw trade access where an account is misused. Purchases made wholly or mainly for business purposes may be subject to business provisions in the Shop Terms and do not necessarily carry consumer cancellation rights.

11. Links and third-party services

The Website may link to third-party websites, payment providers, social networks and services. We do not control third-party websites and are not responsible for their content, availability or terms. A link does not imply endorsement unless we expressly say so.

12. Security and viruses

We take reasonable measures to operate the Website securely but cannot guarantee that it will always be free from bugs, vulnerabilities or malicious code. You should use appropriate security software and maintain your own backups where relevant.

13. Our responsibility for Website use

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud or fraudulent misrepresentation and death or personal injury caused by negligence.

If you are a consumer, we are responsible for foreseeable loss and damage caused by our breach of these Terms or failure to use reasonable care and skill, subject to applicable law. We are not responsible for business losses suffered by consumers.

If you use the Website for business purposes, to the maximum extent permitted by law we exclude implied warranties concerning the Website and will not be liable for indirect or consequential loss, loss of profit, business, opportunity, goodwill or data arising from Website use.

14. Privacy and cookies

Our Privacy Policy explains how Autaway Limited uses personal information. We also use cookies and similar technologies. Non-essential cookies should only be used where legally permitted and, where consent is required, in accordance with the choices made through our cookie controls.

15. Changes to these Terms

We may update these Terms to reflect changes in law, the Website or our business. The current version will be published on the Website with the latest update date. Changes do not retrospectively alter contracts already made for purchases.

16. Governing law

These Terms are governed by the law of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you retain any mandatory rights to bring proceedings in the courts available to you under applicable law. Business users submit to the exclusive jurisdiction of the courts of England and Wales.
